David Clark
David is the Chairman and State Manager – Western Australia for Mortgage Settlements Australia. He has gained extensive financial services experience as the senior partner in charge of one of the largest mortgage and securities practice in Western Australia.
David practices almost exclusively in banking and property.
David is:
- The Chairman of the Western Australian Conveyancing Industry Liaison Committee
- A member of the Western Australia State Government Community Title Advisory Committee
- A member of the Western Australia Department of Land Information Customer Service Council
- A member of the Western Australia Law Society Property Committee
- A member of the Western Australia Steering Committee into Electronic Conveyancing
David also has an array of high net worth clients/developers who rely on him for his extensive knowledge of property law in Western Australia.

Sam Makhoul
Sam is the Chief Executive Officer and State Manager - New South Wales/Australian Capital Territory for Mortgage Settlements Australia. Sam has renowned expertise in mortgage and securities law and particular expertise in a variety of property and commercial transactions.
Having Completed a Master of Laws degree at UNSW majoring in finance law Sam continues to be very active academically and writes a number of articles which have been published. He was one of the first lawyers to work with a title-insured lending program in Australia and has consulted one of the largest publicly listed title insurance companies in the U.S. in the set-up of its Australian operations.
As well as acting for a number of private corporations, Sam has advised and acted for a number of banking and financial institutions. Sam has expertise in all legal and practical aspects of the mortgage process and has presented training seminars and workshops for many originators, mortgage managers and lenders.
Sam has a variety of skills ranging from UCCC & FSRA compliance, human resources management, process engineering and information technology. In addition he has excellent insight into market conditions and consumer needs and has a wide network of contacts in the mortgage industry.

Nicholas Hughes
Nick is the National Marketing Director and State Manager – Victoria for Mortgage Settlements Australia. A major part of Nick's role for MSA involves identifying emerging market trends and developing strategies and valued added services to respond to these ever changing market demands. He combines his highly proficient applied technology and business development skills with the group’s vision for achieving innovative yet pragmatic client focused service solutions.
The majority of Nick's clients are primarily involved in the banking and finance industry. His broad commercial experience sees him regularly advising clients in regard to general commercial matters such as the sale and purchase of businesses, conveyancing, insolvency, bankruptcy and debt collection, franchise law, intellectual property and licensing and litigation matters. He provides advice to clients on a local, national and international basis in regard to issues related to their operations.
Nick’s extensive career has focused not only on financial services but senior management roles in the commercial sector. These achievements afford Nick with a high level of business acumen positioning him well for his role as National Marketing Director. An adept public speaker Nick undertakes regular speaking engagements to lenders, mortgage managers and broking groups on how to minimise the risks and associated legal pitfalls that can affect a successful outcome in mortgage production and settlement.

Paul Agnew
Paul is the Compliance and Risk Management Director and State Manager - Queensland for Mortgage Settlements Australia. He is also a partner of McKays Solicitors. His specialist skills in banking and finance laws are complimented by his extensive experience in litigation, property and commercial law. Paul has worked as a solicitor at Denton Wilde Sapte, a multi-national firm in London and as a senior associate for a national firm in Australia, specialising in banking & finance.
He has completed numerous transactions involving property/consumer finance, acquisition finance, construction and development finance, domestic and international stamp duty savings arrangements, managed investment schemes, government finance, commercial finance, insolvency and privacy legislation for major domestic and international lenders and companies.
Paul has provided over 100 articles for receivers, liquidators, administrators, lenders and banks in relation to various topics. Recent articles included the “Attack on Rights of Lenders to Indefeasibility of Title”, “Default Damages vs Penalty Interest”, “Rights of Individual Guarantors to Terminate a Guarantee”, “Charges Explained”, “Advertising Issues – Consumer Credit Industry”, “Rural Lending Issues”, “Taking Security in Foreign Jurisdictions” and “Misleading and Deceptive Conduct”.

Lachlan Andrews
Lachlan is the State Manager – South Australia/Northern Territories for Mortgage Settlements Australia. He has extensive experience in property law.
Lachlan's particular areas of expertise include:banking and finance, documenting and settling retail, property and business loans;mortgage industry legislation;consumer credit code, including advising on compliance issues;stamp duty;Lands Titles Office and Revenue SA processes and procedures; and how to efficiently deal with these in the context of volume transactions.
Lachlan is the partner responsible for providing retail mortgage securities documentation to banks, credit unions, mortgage providers and finance companies. Lachlan has been engaged to assist clients in managing their mortgage processing systems.
He has established documents and procedures for several lenders with particular emphasis on the Consumer Credit Code and Banking Code of Practice.

Will Justo
Will is the State Manager – Tasmania for Mortgage Settlements Australia.
He has extensive legal expertise in the lending, commercial and conveyancing markets. He also practises in the Wills and Estates arena.
